Terms and Conditions

Trading Terms and Conditions of ACM Jobs (Arts Culture Media Jobs).

It is your responsibility to read the following terms and conditions. Should you have any problems in understanding them please contact us at terms@acmjobs.com

You acknowledge that to use this site you must be 18 years of age or over and are responsible for your actions as the terms and conditions dictate.

In the use of this website or any of our services you are bound by these terms and conditions, and may not rely on any terms or conditions or representations other than those outlined here.
You may also not vary these terms and conditions without the written consent of ACM Jobs. If you do not wish to comply with or be bound by these terms and conditions please do not use our website.

Nothing in any contract or agreement between you and ACM Jobs is intended to prejudice your statutory rights.

If any part of these terms and conditions is held to be invalid the remainder will still stand.

1. DEFINITIONS IN TERMS AND CONDITIONS

1.1 In the TERMS AND CONDITIONS the following terms shall be explained as follows:

ACM Jobs or 'the website' refers to the partnership of Arts Culture Media Jobs which is operated at the following website addresses:

ACM Jobs is also referred to in this document as 'we' or 'us' or 'our'.

The terms 'job seeker(s)', 'employer(s)' or 'advertiser(s)', also referenced as 'you', 'your', 'they' and 'their', refer to any person using the ACM Jobs website.

In these terms and conditions, the definitions of the terms 'employer(s)' and 'advertiser(s)' differ in the following way:
The term 'employer(s)' refers to any person or business listing a job for the sole purpose of seeking an employee. The term 'advertiser(s)' refers to a person or business placing a textual or image-based advertisement on our pages for the purpose of seeking customers for goods or services.

In these terms and conditions, the definitions of the terms 'posting' and 'listing' differ in the following way:
'Listing' refers to the action by ACM Jobs of the placing on the website of a job that has been submitted by an employer.
'Posting' refers to the completion of a Job form by an employer. This form is reviewed by ACM Jobs prior to 'listing'.

The term 'working day(s)' is understood by ACM Jobs to refer to weekdays (i.e. Monday to Friday) excluding public holidays.

The term 'unsuitable', when used with regard to material submitted to ACM Jobs or listed on the website, is understood by ACM Jobs to refer to material that is deemed by us to be offensive, abusive, indecent, defamatory, obscene or in breach of third party intellectual property rights.


2. OBLIGATIONS OF ACM JOBS TO THE JOB SEEKER

2.1 At ACM Jobs we seek to provide a comprehensive listing of available jobs in the Arts, Media and Culture sectors. For this purpose, we provide the use of search engines and the facility to browse by sector.


3. OBLIGATIONS OF THE JOB SEEKER TO ACM JOBS

In using our facilities you the job seeker agree

3.1 not to falsify information in registration, and to accept full responsibility for any material you provide in registering with ACM Jobs.

3.2 not to send unsuitable or obscene material or viruses/worms via email or other contact method (see 1.1).

3.3 not to copy, use or download any of the images on the site, all of which are the sole property of ACM Jobs

3.4 to accept full responsibility for responding to any job listings or advertisements on the website.


4. OBLIGATIONS OF ACM JOBS TO THE EMPLOYER

4.1 At ACM Jobs we seek to provide an attractive and user-friendly website for listing jobs solely within the Arts, Culture and Media sectors, helping you to attract a high quality candidate.

4.2 We endeavour to advertise and list the website with search engines in order to attract as many suitable job seekers as possible to the website.

4.3 ACM Jobs will endeavour to list a job on the website within 2 working days of the job being submitted (see 1.1). For example, if posted on a Friday a job may not appear until the following Tuesday. The duration of listing requested by the employer will begin from the date the job is listed on the website.

4.4 We remind you that ACM Jobs is not a recruitment service and does not match job seeker to Job. You contact a job seeker at your own risk. See 11.1 for further details.


5. OBLIGATIONS OF EMPLOYER TO ACM JOBS

In accessing these facilities you the employer agree

5.1 that you are a genuine employer, will not falsify information either in registration or in posting a job and accept full responsibility for the material you post.

5.2 that ACM Jobs maintains the right not to publish any job listing deemed unsuitable that is sent to us via the website or to remove a job listing without notice if it is found to have objectionable content. If a payment has been made and your job listing is rejected before listing you may request a refund. If a payment has been made and your job listing is removed before the expiry date, you may request a refund for the period between the removal of the advertisement and the expiry date of the job listing.

5.3 not to upload or send unsuitable or obscene material or viruses/worms via email or other contact method or on the job posting template (see 1.1).

5.4 not to copy, use or download any of the images on the site, all of which are the sole property of ACM Jobs.

5.5 to accept full responsibility for responding to any applicants as a result of the job being listed on the website.


6. ADVERTISERS

ACM Jobs provides an opportunity for those companies deemed suitable by us to advertise on various pages of the website.
In order to do this, advertisers may contact us directly.

6.1 As the advertiser, you agree to act within the advertising laws of England and Wales and to accept full responsibility for any consequences as a result of advertising with us. You also agree to accept full responsibility for the content of your advertisement.

6.2 ACM Jobs reserves the right to remove without notice any advertisement should the status of the advertising company change and become incompatible with that of ACM Jobs during the listing period, or if it is discovered that an advertisement contains unsuitable content (see 1.1). In the event of such an occurrence and if the advertisement has been paid for, the advertiser will be refunded for the period between the removal of the advertisement and the original expiry date of the advertisement.


7. REGISTRATION

When you, as a job seeker or employer, register with ACM jobs

7.1 you agree not to falsify information. Your username and password are your property and it is your responsibility to keep this information safe. It should not be passed on to another party. Should you suspect interference, you should change your password using the facility provided immediately.

7.2 Registration also provides you with an opportunity to access other parts of the site, in order to do such things as browse or search jobs and post jobs.

7.3 On registering, we will store your details in our secure database for reference purposes only. For example, we may use this information to contact you regarding a transaction or to inform you of our promotions (if this has been requested) (please see 12.4). We act in accordance with the regulations as stated by the data protection act of 1998 (see 12.1).


8. OWNERSHIP OF WEBSITES

This website and the content of this website, at any of the addresses as listed in 1.1, are the sole property of ACM Jobs. By using this website you agree not to download, copy or use any of the structure, text, images or logos, all of which are the sole property of ACM jobs.


9. COST OF SERVICES

This website is free to use unless placing a job or advertisement. However we may sometimes have promotions when even these services are free of charge. Check our rate card for current charges.

All prices are in pounds sterling and are inclusive of any taxes. If the status of this changes you will be fully informed in our rate card.


10. ACCESS OF WEBSITE

10.1 The website of ACM Jobs is provided on an 'as and when available basis'. We offer no representation or warranty to the effect that the website or services offered via the website will be accessible, useable or error-free.

10.2 ACM jobs cannot assume any liability for any interruptions to the access of the website which are beyond our control (e.g. communication and technical failures). Should interruption occur we will use reasonable endeavours to rectify the situation, although we are under no obligation to do so (see also 'force majeure' clause in 11.6).

10.3 ACM Jobs has the right to restrict access of the website if a user is deemed to be in abuse of it.


11. LIABILITIES/INDEMNITY

11.1 As a user of the website you agree that we have no control over third party agreements or negotiations which are made as a result of accessing our website, and we are exempt from any liability for loss or damage arising from use of our website, at all the addresses listed in 1.1.

11.2 We are exempt from all liability for any security lapses in the services and for any disruption, corruption or loss of material. We provide no warranty whatsoever for any goods or services purchased from advertisers that have advertised on our website.

11.3 We accept no liability for any textual errors or inaccuracies which may appear on the website. You accept all responsibility for any text posted to us via the Job Posting sections.

11.4 The user indemnifies ACM Jobs against any claims brought against ACM Jobs and any of their employees arising from your use of the websites, and/or regarding the use or misuse of a job seeker's or employer's information by a third party and/or a breach of any of these terms and conditions.(Please see the disclaimers in 14).

11.5 ACM Jobs declares that it does not intend any term in these terms and conditions to be enforceable by any third party within the meaning of the Contracts (Rights of Third Parties) Act 1999.

11.6 ACM Jobs shall not be liable for failure to perform its obligations outlined in these terms and conditions to the extent that such failure is caused by any cause beyond its reasonable control. The following shall be regarded as causes beyond ACM Jobs' reasonable control:

Acts of God, explosions, flood, tempest, lightning or fire, act or accident;

Acts of terrorism;

Omission of Government, highways authorities, war or the threat of war, military operations, sabotage, riot, insurrection, civil disturbance or requisition;

Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of ACM Jobs or third parties);

Power failure or breakdown of equipment or the Network.


12. PRIVACY POLICY AND DATA PROTECTION

12.1 ACM jobs operates in accordance with the Data Protection Act, 1998 and the Privacy and Electronic Communications (EC Directive) Regulations 2003. Should you wish to know the information we hold on you, you can request it from us and we must respond to it within 40 days.

12.2 The only personal information of yours that we store is that which you provide to us when registering. This information will not be passed on to any third party and will be kept solely for our reference. As mentioned in 12.2, we do not have access to your credit card information.

12.3 Please be aware that any personal information you post which will form part of either an advertisement, job listing can be viewed openly and easily accessed by users of the website. Please ensure that you have the consent of the owner before submission if using a third party's personal information. You agree to take full responsibility for the open disclosure of information in this manner.

12.4 We will only contact you in connection with our business relationship or to update you on ACM Jobs promotions if you have requested this service when registering.

12.5 Our policy at ACM jobs is that we do not use 'cookies' in registration or when you access areas where entry by password is required. However, we cannot guarantee that this is also the policy of our advertisers, many of whom place links on our site.


13. ACM JOBS REFUND POLICY

13.1 Customers who have ordered any of our services (i.e. listing of jobs or advertisements) have the right to cancel before listing of the job or advertisement has been performed. They should notify ACM Jobs in one of the ways listed on our contact page, quoting the job ID or a clear description of the advertisement.

13.2 In the event of the cancellation (prior to listing) of a listing or advertisement that has been paid for, the relevant customer will have his/her payment refunded within 30 days of cancellation.

13.3 In the event of the removal by ACM Jobs of a job listing or advertisement that has been paid for, the relevant customer will have his/her payment refunded for the period between the cancellation and the original intended expiry date of the listing or advertisement.


14. DISCLAIMERS

General

ACM Jobs does not

14.1 provide a recruitment service, and will not match job seekers to the jobs. The job seeker is responsible for finding jobs using the search engines and browsing options provided. ACM jobs is solely a listings resource for both job seeker and employer. Please note that any employer is free to advertise jobs in the listings, and that any communication or relationship in response to a listed job is entirely between the job seeker and the employer.

Please note that ACM jobs cannot accept any responsibility for the way an employer, job seeker or advertiser may operate and that our only relationship with them is in purely in providing them with a listings service.

14.2 accept responsibility for any computer Virus, Trojan Horse, Worm or any other destructive online device which may be delivered to you as a result of using this website. However we will use reasonable means to keep our website and email service free from such perils.

14.3 accept responsibility for any attack by a hacker on our database or website, although we will take reasonable steps to prevent such occurrences.

14.4 accept liability for any dealings between you and a third party: should you respond to advertising on the website you do so at your own risk and take full responsibility for doing so.

14.5 accept responsibility for the content or errors of any listing, whether advertising, a Job listing. The user is advised to check content before submission. ACM Jobs will endeavour to make corrections on your behalf but cannot guarantee to do so.

Regarding posting jobs and job seeking.

ACM Jobs does not

14.6 accept responsibility for any unfortunate circumstances which could occur as a result of a job seeker contacting an employer or vice versa. This is an open resource and as the job seeker or employer you should use your own discretion as to whom you communicate with. ACM jobs cannot accept any responsibility for any unwanted contact as a result of posting a job and you agree to post a job at your own risk.

14.7 guarantee any contact or interest from employers or job seekers as a result of listing a job on the website.

14.8 guarantee to list a job until we have reviewed the material. We reserve the right not to publish any job we deem unsuitable. Should you have paid for the service and your posting is rejected you will be informed and are entitled to a refund within 30 days of payment.


15. CHANGES TO TERMS AND CONDITIONS

15.1 ACM Jobs reserves the right to update and make changes to the terms and conditions as and when they see fit without prior notice. The date of the last update shall be listed on the terms and conditions. It is your responsibility to read them.

15.2 You may not vary these terms and conditions without the written consent of ACM Jobs.


16. YOUR CONSENT TO THE LAWS OF ENGLAND AND WALES

In using this website (at all the addresses listed in 1.1) you agree that you are aged 18 years or over and also agree to be bound by the terms and conditions as stated, which will be governed by and interpreted in accordance with the laws of England and Wales.
